I don't know of any off the top of my head that are graduated like the weight regulations. And size and weight aren't covered by the NRVC, so a non-Texan shouldn't worry about it nearly as much as a speeding ticket. And South Dakotans don't need to worry about those much either (or photo enforcement tickets).

 

Here's the Texas penalty section:

Sec. 621.507. GENERAL OFFENSE; PENALTY. (a) A person commits an offense if the person violates a provision of this subtitle for which an offense is not specified by another section of this subtitle.
( An offense under this section is a misdemeanor punishable:
    (1) by a fine not to exceed $200;
    (2) on conviction before the first anniversary of the date of a previous conviction under this section:
        (A) by a fine not to exceed $500, by confinement in a county jail for not more than 60 days, or by both the fine and confinement; or
        ( if the convicted person is a corporation, by a fine not to exceed $1,000; or
    (3) on a conviction before the first anniversary of the date of a previous conviction under this section that was punishable under Subdivision (2) or this subdivision:
        (A) by a fine not to exceed $1,000, by confinement in the county jail for not more than six months, or by both the fine and confinement; or
        ( if the convicted person is a corporation, by a fine not to exceed $2,000.

Max $200 and no jail time (not that they would anyway--the local court would rather have the cash) isn't worth a detour.

 

Hmm,

The way that is worded, it is not a traffic offence but a misdemeanor criminal offence.

A traffic offense in Texas IS a criminal offense. Most are Class C misdemeanors punishable by a fine only...unless otherwise specified. Red light cameras and parking violations in some municipalities are the only civil violations we have in the state.

 

And if you think that is rough you should see the fines for overweight:

(3) on conviction of an offense involving a vehicle having a gross weight that is heavier than the vehicle's allowable weight, by a fine according to the following schedule:

Pounds Overweight

Fine Range

less than 2,500

$100 to $500,

2,500-5,000

$500 to $1,000

5,001-10,000

$1,000 to $2,500

10,001-20,000

$2,500 to $5,000

20,001-40,000

$5,000 to $7,000

more than 40,000

$7,000 to $10,000.

 

I wrote a truck for being 106,000 lbs over weight the other day. The permit would have cost a lot less than that fine.

It might sound like it at first glance, but it's a good thing for the average Joe. It means that you're innocent until proven guilty, and the standard of proof is beyond a reasonable doubt. Civil traffic offenses are one of the worst things out there for the motorist, after equitable sharing/civil forfeiture. Even some things, like running a red light, have been written as civil parking infractions in some places--i.e. the idea that you're illegally parked in the intersection (even if moving)--to get around state laws regulating moving violations. The town crafts a civil offense, and then doesn't have to prove who did it (assessing the registered owner), they keep the money local instead of sharing with the state, and they keep the fine amounts low enough that most people couldn't justify fighting.

 

The one place there's recently been some reversal has been in federal courts, where there's been push back on bench warrants for failure to pay. The courts are starting to say that if it's a civil matter, it's a civil collection matter, and have struck down what was amounting to a debtor's prison.

Years ago I used to pull a lot of oversize loads. I was sitting in a truckstop eating lunch and a guy was telling me "You don't need permits. Your chances of getting caught are slim". He really ranted on the permit system then proceeds to tell me how much of a problem he had when he was at a weigh station......... Like one cop in Minnesota told me "If you are going to move a load with out a permit at least make it LOOK legal" meaning have all the signs and flags on and they probably wouldn't look twice........

Oh not to worry....crane Geeks are in charge of spreading large sums of money around....

 

In my childhood I was not paying attention and wound up managing a marine heavy lift outfit for a while and we had a assortment of barges, tugs, trucks and small cranes and a couple of not so small cranes.

 

The big momma crane was 550 Ton capacity and a royal pain in the keister to manage.

 

Striped for the road it was 10 feet wide, 110 feet long and had 10 axles to carry it's featherweight min of 229,000 lbs Dry.

 

The permit was the easy part .....the hard part was finding a route to drive over and the real chore was hiring the cops to stop the traffic on certain bridges so that the unit could straddle the centerline without falling through the bridge deck.

 

Of course with the +800 HP /3100 tq Man diesel it was able to cruise up to 50 mph wide open and sometimes get up to 2 mi/gal.

 

So taking big-momma out for a spin without a permit and a bunch of escorts was a serious.....crime.... Miss Molly at DMV told me that moving big-momma without a permit was a firing-squad offense....

 

One holiday weekend the Corps of Engineers beat my door down and wanted big momma moved right now, I said NO since I could not get a permit and I would face a firing-squad without a permit.....the Corps engineer said well sir it looks like you just need to choose which firing-squad you would be shot by....the DMV...or...the Corps ......Gulp.

 

So nobody got shot and no bridges were damaged so only the holiday was shot in the end.

 

Drive on.....(permits are cheep...)
