Polk County judge issues stay-at-home order as a precaution due to COVID-19

Information for Escapees who may be staying in Polk County Livingston, Texas

POLK COUNTY, Texas (KTRE) - From Polk County Emergency Management:

Today, Polk County Judge Sydney Murphy issued an Executive Order (Order to Stay Home) out of an abundance of caution to protect the health and safety of Polk County residents during the COVID-19 Pandemic.

This order requires individuals to remain at home or at a place of residence, with exceptions for essential work and activities. This order will take effect at 11:59 p.m. on March 27, 2020 and shall be effective until 11:59 p.m. on April 3, 2020 until it is either rescinded, superseded, or amended pursuant to applicable law. Please see the attached order for further details.

In accordance with Government Code Section 418.108(h), after a declaration of local disaster by the County Judge, the jurisdiction and authority of the County Judge includes the incorporated and unincorporated areas of the County. Under Government Code 418.173, violations of the declaration of disaster and orders may be punishable by a fine not to exceed $1,000 or imprisonment in the jail not to exceed 180 days.

Howdy!

Elected County Judges can, that’s who close Harris (Houston) and other counties.

I have not heard of any reported cases of the virus in Polk County.

A Texas county judge is the administrator of the county and sits at the head of the county board of commissioners.  He is not part of the judiciary.  County judges are very powerful in Texas.

He's more like a city manager, only for the county.

SWharton. that is the way things are done in Texas.  You want confusion, go to Louisiana,  They call the county commissioners the police jury.

Louisiana does not have county’s they have a parish like the church. Also they are the only State in the union that is not based on English common law, they are based on Nepolianic (not sure I spelled that correct) law.

What about people who travel from one county to another? Is that prohibited? I guess I am in the all or none camp. We are in AZ and the stay at home is not seriously impacting anyone, people are generally staying home but not hesitating going out when necessary. Be easier when the food chain catches up.

We live in Rockport TX which is in Aransas County which is ~30 miles east of Corpus Christi which is in Nueces County.  Many people in Aransas and nearby San Patricio countries work in Nueces County.  Currently, Nueces has a "stay home" order in place beginning at midnight tonight, but Aransas and San Patricio don't.  Is it Ok for someone from Nueces to come to my county to take part in a non-essential activity which is prohibited in his country (Nueces) but not in mine?  Or the reverse?  It would be a lot more sensible if there was uniformity.

Virtually every county in TX has at least some COVID-19 cases.  COVID-19 cases in TX

Some Counties, for example Kleberg, have issued stay home orders even though they have practically no cases. Other counties have not.  Do you really expect that the virus won't spread throughout the State unless strong measures are taken to prevent it?

With regard to what to call county leaders, if you lived here, it wouldn't be confusing at all.  The county leader is called a judge because the commissioners are part of a "commissioners court".  It doesn't have to make sense to anyone outside of here.

Texans believe in local control of most things, kind of like our country used to be.  The Governor could step in and take charge, but he has left it up to the counties to make most of these decisions.  He did order that restaurants and bars could not serve in house.  There are 254 counties in Texas.  One size does not always fit all.

If you feel unsafe with Texas' methods, I advise to not come here.  You have a choice.  🙂

It really was before joining the U.S.A. With the average age in Polk county, that decision sounds very prudent.

As a transplant to TX, I too have struggled with the idea that the leader of the county commissioners is a judge, but it is simply a title and in reality the commissioner's court is exactly the same as the county commission in most states. It is rather like Louisiana where then call political subdivisions that we call counties a parish.

Except the annexation agreement went after the window after Texas seceded and joined the CSA.   When they lost, they became like any other state, under federal jurisdiction.  Yes, I know there is always some legislator who introduces a bill to break up the state or to withdraw, but it is all meaningless now.  Texas (like California) could only break up if (1) a majority of the voters in the state agreed and (2) both houses of Congress agreed.

Isn't Texas the state where the Lt. Governor said  "in an interview with Fox News host Tucker Carlson on March 23, 2020, Patrick stated that he was willing to risk his life from the coronavirus pandemic if it would avoid an economic shutdown, which he stated would negatively impact subsequent generations. Patrick also stated that he thought many grandparents agreed with him on this."  How many of you grandparents living in Texas are in agreement with him?
