Handgun purchase in South Dakota

Hi All,

 

Like many others, my residence is in South Dakota and the address of the mail forwarding service is on my driver license. The address is the physical address of the mail service, and it includes a PMB number that identifies my "box" (Postal Mail Box, I think).

 

I was told by a local gun dealer that if a physical address where I actually reside isn't on my driver license, I cannot legally purchase a handgun in South Dakota. The example they gave was if someone could knock of the door of the address on my driver license and I answered the door, I would be fine. If not, then no.

 

If this is accurate, and since I don't physically live in the office of the mail service, it means I cannot legally purchase a handgun anywhere in America.

 

Have any of you dealt with this issue?

I bought one from a friend in CO. He had bought it a couple of years before he sold it to me so it was not a straw buy.

 

My friend Bud got an AZ ID card and bought a handgun in AZ. He was a resident of NY state but was still able to legally get the AZ ID card.

I have been an Escapees member since Mar. of 1997 and used the mailservice as my only address the entire time. Over that time I have bought 2 or 3 handguns from either gunshops or in one case a gunshow in Texas without a problem but I was not able to buy one in another state. I hope this will be useful to you.

I have a mail service on my SD driver's license and have bought both handguns and long guns in SD. The only place that will not sell to me is Cabala's and your quote is what they told me. I recommend going to Scheels, Big R, or any other sporting good store and shop.

 

My most recent handgun purchase was a limited edition Ruger revolver bought at a local gun store in Rapid City last year. They thanked me for my business then put the gun in a bright yellow bag that said "GUNS" on it. Hubby was mortified! :D

You can still legally purchase handguns at gun shows I believe.

While in a Bass Pro Shop in Texas, I asked about purchasing a handgun being an out of state resident. The clerk looked in his computer and said no problem with me being an SD resident purchasing a handgun in Texas. Don't know if he was wrong or not, and I didn't buy that day.

He was not wrong, but misleading. :rolleyes:

 

It's a federal law that you can only buy handguns and receive the purchase in your home state. You may buy a handgun out of state but you can't take it with you, it must be shipped to an FFL holder in your home state.

Alaska puts your mailing address instead of your resident address on drivers licenses. Perhaps this is because mail is not delivered to many residences and if you want mail you have to go get it. To purchase a handgun gun shops therefore accept a DL combined with a voter registration card.

Interesting, thanks for the link. But since it's only the Texas court that deemed the act unconstitutional, it changes nothing for now. If the ruling survives appeals, may make for a better market.

I just bought one this past summer in Sioux Falls with PMB on drivers license with no problem. It was at a gun shop and took gun home same day. I was surprised there was no waiting period.

Only ten states have waiting periods for the purchase of handguns.

Ah, but see, that is the advantage of the Escapee address in that it DOES NOT list our addresses as a "Box Number" but as an address with an additional number which could be apt, or whatever.

keep this in mind.in SD if you have a comm.drivers licence the address on your licence has to match your actual address of residence.I had to change the address on my licence to purchase a shotgun.I had a previous mailing address on my licence of a friends house and had not changed it to my property address.

It is only Cabalas and Schields in Rapid City that have this rule. I was told the same explanation (about knocking at the door) at Schields. I was advised by the salesman at Schields that the ATFE has pushed these two stores to make this policy. Other gun stores in Rapid city do not have this rule. It applies to any gun purchase, hand gun or long gun.
